Throughout these Terms and Conditions (“Terms”, “Agreement”), “we”, “us”, “our”, or “the Brokerage” refers to Centum Indigo Mortgage Corp. and its licensed brokers and agents, including Anna George. “You” refers to any visitor or user of the Site.
By accessing or using this Site, you agree to be bound by these Terms. If you do not agree, please do not use this Site.

 

2. Nature of This Site and Our Services

This Site is provided for general informational purposes about mortgage brokering and related real estate services available in Ontario. Nothing on this Site constitutes:

• a mortgage commitment, pre-approval, or guarantee of credit;
• legal, tax, accounting, or personal financial advice; or
• an offer to lend money.

Mortgage products, interest rates, terms, and lender programs referenced on this Site are for general illustration only, are subject to change without notice, and are not guaranteed. Any rate or figure shown may not reflect current market conditions. Please contact us directly for current rates and to discuss what applies to your specific circumstances, and confirm final terms in your written cost of borrowing disclosure statement before signing any mortgage commitment.
All mortgage applications are subject to lender credit approval, underwriting, and standard conditions (“on approved credit” / “O.A.C.”). We do not guarantee approval, rate, or funding of any mortgage.

 

3. Our Regulatory Disclosures (Mortgage Brokering Services)

As a matter licensed under the MBLAA and its regulations, we are required to make the following disclosures to you:

a) Our relationship with lenders. Centum Indigo Mortgage Corp. works with multiple lenders, including banks, credit unions, monoline lenders, and, where suitable, private lenders. We are not the agent of any single lender. Where we act, or a related person or entity acts, as both broker and lender (or has a material interest in the lender or property), or where we are receiving compensation from more than one party to a transaction, this will be specifically disclosed to you in writing before you enter into a mortgage agreement, as required by Ontario Regulation 187/08 and Ontario Regulation 188/08.

b) How we are compensated. Centum Indigo Mortgage Corp. and its brokers/agents are typically compensated by the lender, in the form of a finder's fee, commission, or similar payment, once a mortgage is funded. In some circumstances (for example, certain private mortgage transactions), a fee may also be charged directly to you. Any fee payable by you will always be disclosed to you in writing, including the amount or how it is calculated, before you agree to pay it. You are entitled to ask your broker or agent for details of how they are compensated on your specific transaction.

c) Cost of borrowing disclosure. Before you sign a mortgage commitment, we will provide you with a written disclosure statement setting out the cost of borrowing and other required information, in accordance with Ontario Regulation 188/08. For most mortgage transactions, this disclosure must be provided within a legislated waiting period before you are asked to sign, so that you have a reasonable opportunity to review it. Ask your broker/agent about the specific timelines that apply to your transaction.

d) Private mortgages and higher-risk products. Private mortgages, second mortgages, and certain alternative lending products may carry higher interest rates, lender/broker fees, and shorter terms than conventional institutional mortgages. Where applicable, additional risk disclosures and, in some cases, independent legal advice, are required before you proceed. We will identify these requirements to you where relevant.

e) Reverse mortgages. Reverse mortgage products allow eligible homeowners to borrow against home equity without regular payments; however, interest accrues and compounds over the life of the loan, which reduces the equity remaining in the home over time and may affect your estate. Lenders offering reverse mortgages generally require applicants to obtain independent legal advice before signing. We encourage anyone considering a reverse mortgage to review all costs, risks, and alternatives carefully, and to seek independent legal advice.
f) No guarantee of a particular outcome. While we work to find suitable options based on the information you provide, we do not guarantee that any particular lender, rate, or mortgage product will be available to you, or that your application will be approved.
Nothing in this section limits or replaces the formal, written disclosures you are legally entitled to receive from us during an actual mortgage transaction. This Site is not a substitute for those disclosures.

 

4. Real Estate Services

Anna George also provides real estate services in connection with the purchase and sale of residential property as a Real Estate Broker for Kingsway Real Estate. Real estate trading activity in Ontario is separately regulated under the Trust in Real Estate Services Act, 2002 by the Real Estate Council of Ontario (“RECO”).

Mortgage brokering and real estate trading are separate regulated activities governed by separate

regulators (FSRA and RECO respectively). Engaging Anna George for one service does not obligate
you to use her for the other, and you are free to choose independent professionals for either service.

Content on this Site, including blog posts, glossary entries, calculators, market commentary, and FAQ content, is for general educational purposes only. It is not a substitute for individualized advice from a lawyer, accountant, licensed financial planner, or other qualified professional. 6. Permitted Use of This Site

Where this Site allows you to submit an application, inquiry, or other personal information (for example, through an online application form), that information is collected, used, and disclosed in accordance with our Privacy Policy, applicable Ontario mortgage brokering regulations, and the federal Personal Information Protection and Electronic Documents Act (“PIPEDA”). By submitting information through this Site, you consent to that collection, use, and disclosure as described in our Privacy Policy. You agree to provide true, accurate, and complete information and not to submit information on behalf of another person without their authorization.

9. Intellectual Property

All content on this Site — including text, graphics, logos, the Centum® and Centum Indigo Mortgage Corp. names and marks, images, calculators, and the layout and organization of the Site — is owned by, or licensed to, Centum Indigo Mortgage Corp., or their respective third-party owners, and is protected by Canadian and international copyright and trademark law. No licence to use any trademark is granted without our express prior written permission. All other trademarks appearing on this Site are the property
of their respective owners.

This Site may contain links to third-party websites, including lender websites, calculators, or industry resources, provided for your convenience. We do not control, endorse, or take responsibility for the content, accuracy, products, services, or privacy practices of any third-party site. 12. Limitation of Liability

To the fullest extent permitted by law, Centum Indigo Mortgage Corp., Anna George, and their respective agents, employees, and suppliers will not be liable for any direct, indirect, incidental, special, or consequential damages arising out of, or in connection with, your use of, or inability to use, this Site, or your reliance on any information contained on it. Nothing in this section is intended to limit any liability that cannot be excluded under Ontario law, or any obligation we owe to you under the MBLAA and its regulations in respect of an actual mortgage transaction.

 

13. Indemnification

You agree to indemnify and hold harmless Centum Indigo Mortgage Corp., Anna George, and their respective agents and affiliates from any claim, liability, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms or your misuse of this Site.

 

14. Governing Law and Jurisdiction

These Terms, and any dispute arising out of or relating to this Site, are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that any legal action relating to this Site or these Terms will be brought exclusively in the courts of the Province of Ontario.
